CAS DANIUTE: 3 MONTHS SUSPENSION CONFIRMED

In its Decision (Arbitral Award) dated June 26th 2007 the Court of Arbitration for Sport (CAS) at Lausanne, Switzerland, confirmed the Decision of the IDSF Disciplinary Counsel dated November 17th 2006 regarding the Anti-Doping rule violation of Edita Daniute from Lithuania: 3 months suspension from September 14 to December 14, 2006. Edita Daniute was tested at the IDSF Grand Slam Standard at the German Open at Stuttgart August 19 2006. At September 14 2006 the IDSF Anti-Doping Director received the information that the laboratory analyses of her urine sample proved the presence of subitramine, a forbidden substance of the category S6, Stimulants. Since sibutramine is also listed as so called "specified substance", a reduced sanction might be imposed. The IDSF Anti-Doping Director requested the IDSF Disciplinary Counsel (DC) to handle and decide the rule violation. The IDSF DC Decided the case, after hearing Daniute, on November 17th 2006. The IDSF DC sanctioned Daniute with a 3 months suspension from competition, international as well as national. On November 21 2006 Daniute filed an Appeal with CAS against the Decision of the IDSF DC, at the same time requesting for a stay of the execution of the IDSF DC decision. On November 23 2006 the Deputy President of CAS granted this request for a stay thus allowing Daniute to participate in the IDSF World Championships Standard at Aarhus, Denmark, on November 25 2006. As we all know the couple Bizokas/Daniute won that World Championships. On January 29 2007 the formal Appeal Brief of Daniute was filed with CAS. On March 16 2007 IDSF filed its Answer to the Appeal, the Defence Statement. On April 25 2007 the formal Hearing was held at the CAS office at Lausanne, Switzerland. On June 26 2007 the CAS Decision was issued. Daniute was represented during the procedure by two laywers from Hammonds, London. IDSF was represented by its Anti-Doping Director Ko de Mooy and Anti-Doping Commission member Grischka Petri.
